Darryl Thomas Kemp was convicted by a jury of first degree murder, kidnaping, and two counts of rape. The jury found him to have been sane at the time of the offenses and sentenced him to death for the murder. The judgment was affirmed. (People v. Kemp (1961) 55 Cal. 2d 458 [11 Cal. Rptr. 361, 359 P.2d 913].) Thereafter, under the compulsion of Witherspoon v. Illinois (1968) 391 U.S. 510 [20 L.Ed.2d 776, 88 S.Ct. 1770], the judgment was vacated insofar as it imposed the death penalty and was affirmed in all other respects. (In re Kemp (1969) 1 Cal. 3d 190 [81 Cal. Rptr. 609, 460 P.2d 481].) Upon retrial of the penalty issue, defendants punishment was again fixed at death. The case is before us on automatic appeal. (Pen. Code, § 1239, subd. (b).)
